Election Guidelines: Supreme Court okays INEC’s appeal, dismisses SDP, YP’s suit

The Supreme Court on Thursday upheld the entreaty filed by the Independent National Electoral Commission, INEC, against the Court of Appeal judgement voiding portion of the provisions of the Electoral Act 2026 dealing with governmental enactment primaries and rank registers.

INEC filed an entreaty against portion of the Court of Appeal judgement which voided portion of the Electoral Act, successful a suit commenced by the Zenith Labour Party, ZLP, astatine the High Court.

After proceeding the entreaty filed by INEC, done its counsel, Dr Alex Izinyon, SAN, Justice Adamu Jauro entered

judgment successful favour of the electoral umpire and acceptable speech the Court of Appeal judgement which was successful favour of ZLP.

The Supreme Court upheld the judgement of the proceedings tribunal and besides awarded outgo of N2 cardinal against the responsive ZLP.

The apex court, successful its verdict, held that sections 77(5) and 84 of the Electoral Act are not successful struggle with the 1999 Constitution.
