Delta Governor Oborevwori is upheld by the Supreme Court

The electoral victory of Delta State Governor Sheriff Oborevwori was upheld by the Supreme Court on Friday.

A five-member panel of the supreme court dismissed an appeal brought by the All Progressives Congress (APC) and Senator Ovie Omo-Agege, the party’s candidate, to contest the results of the state’s March 18, 2023, gubernatorial election, in a unanimous ruling.

The court determined that the appeal lacked merit in its lead judgment, which was delivered by Justice Inyang Okoro.

According to the ruling, the APC and its candidate failed to provide evidence that the election was not conducted substantially in accordance with the Electoral Act of 2023.

The Independent National Electoral Commission, or INEC, used certain result sheets without serial numbers, according to Omo-Agege, who claimed that Oborevwori was the election winner. However, the court rejected this argument.

The court stated that Oborevwori’s lead margin would remain unchanged even if all of the INEC forms that the appellants had complained about were eliminated.

It concluded that the Appellants had not met the legal standard of proof, which called for the annulment of the Court of Appeal’s decision as well as the Delta State Governorship Election Petitions Tribunal’s ruling.

As a result, it denied the petition at no expense.

Recall that INEC announced that Oborevwori of the PDP received 360, 234 votes, more than Omo-Agege of the APC, who received 240, 229 votes, to win the governorship race.

The most recent Deputy President of the Senate, Omo-Agege, filed a request with the court to have the election results declared void because he was unhappy with the outcome.
