Supreme Court upholds INEC’s appeal, dismisses SDP, Youth Party cases on election guidelines

The Supreme Court connected Thursday upheld the entreaty filed by the Independent National Electoral Commission (INEC) against the Court of Appeal judgement that voided parts of the Electoral Act 2026 dealing with governmental enactment primaries and rank registers.

INEC had appealed against parts of the Court of Appeal judgement successful a suit instituted by the Zenith Labour Party (ZLP) astatine the Federal High Court.

After proceeding the entreaty filed by INEC done its counsel, Dr Alex Izinyon, SAN, Justice Adamu Jauro entered judgement successful favour of the electoral umpire and acceptable speech the Court of Appeal judgment, which had favoured the Zenith Labour Party.

The apex tribunal upheld the judgement of the proceedings tribunal and awarded costs of N2 cardinal against the respondent, ZLP.

The tribunal held that Sections 77(5) and 84 of the Electoral Act are not successful struggle with the 1999 Constitution.

In 2 different judgments, the tribunal dismissed abstracted appeals filed by the Social Democratic Party (SDP) and the Youth Party (YP) against INEC.
